Governor Maha Prasad Adhikari has Stay order from the Supreme Court

Kathmandu. Suspended Governor of Nepal Rastra Bank Maha Prasad Adhikari has received an Stay order from the Supreme Court. The order came while hearing a writ petition filed by suspended Governor Maha Prasad Adhikari of the suspended Nepal Rastra Bank on Tuesday. A single bench of Justice Hari Phuyal held a preliminary hearing and ordered not to implement the action against the governor.

The Supreme Court has issued a short-term interim order not to immediately implement the action against Governor Maha Prasad Adhikari. Both sides have been called for a discussion on this issue on 13 April.

Governor Adhikari had on Monday filed a writ petition in the Supreme Court alleging that the suspension was illegal. In a preliminary hearing in the Supreme Court on Tuesday, the apex court ordered the government-suspended governor not to take any action.

The writ petition filed by Governor Maha Prasad Adhikari, who was suspended by the government after forming an investigation committee, was heard in the court of Justice Hari Prasad Phuyal. A writ petition seeking an interim injunction was issued in a single sitting of Judge Phuyal.

 According to the NRB Act, there is a provision of automatic suspension after the government starts investigation on the governor and other operators. Advocate Sushil Pant, Shambhu Thapa, Shatish Kumar Kharel, Kushna Prasad Bhandari, Radheshyam Adhikari, Harihar Dahal and 13 others argued on behalf of Governor Adhikari in the writ petition against the government's decision to suspend him. Following their argument, Judge Phuyal issued an interim order not to suspend him immediately.
